As a company interested in bringing a knowledge immigrant to the Netherlands via the IND (Immigration and Naturalisation Service)? If so, there is a certain process to follow to get this done legally.Â
The connection between a knowledge migrant and the IND has everything to do with permit requirements that apply to knowledge migrants. When a knowledge migrant meets these requirements, it is actually possible as a company to hire an expert from abroad.
So, as mentioned, a certain process precedes completing the process of bringing in a knowledge immigrant through the IND. This is because it is this Immigration and Naturalisation Service that handles the residence permits for these people. As an employer, you therefore need to be IND recognised as a sponsor, so that you can officially get permission to allow the knowledge migrant to work within the Dutch borders.Â
The crucial first step for any company is to get IND recognised as a sponsor. This means that, as an employer, you have to meet several conditions. For example, you must not be in financial difficulties, have a certain period of existence and offer clear employment contracts to the knowledge migrant(s). Then, using a specific application form, it is possible to start the process. Please note that there are certain costs involved in this. Need help with this process? Then enlist the help of real experts working on this every day at Payse.
The moment you manage to get approval from the IND to be recognised as a sponsor, it is time to move on to the 2e step; apply for the actual residence permit for the knowledge migrant(s). As an employer, you must apply for this residence permit yourself from the IND. This can be done online or in writing. You may need to apply for a provisional residence permit (MVV) when the highly skilled migrant comes from outside the EU.
After sending all the information towards the IND, they take the application under consideration and start assessing it. In this process, they look at to what extent everything meets the conditions. For example, they pay special attention to the salary requirements and the specific job description. This is because a knowledge migrant must receive a certain minimum salary and have a certain expertise. Also to qualify for specific tax benefits for expats and knowledge migrants.
If, as an employer, you have gone through the entire procedure and met all the conditions, there is only one possible outcome: The highly skilled migrant can start working for your company in the Netherlands. When doing this, make sure no unnecessary mistakes are made and all steps are completed in the right order.
To really ensure that this whole process is done in the fastest, most effective way, it is important to be aware of the details. For example, regarding the list of conditions for employer and knowledge migrant.Â
