Everything you need to know as an employer about the highly skilled migrant (knowledge migrant)

As an employer, it is only natural to be interested in the highly skilled migrant, also known as 'knowledge migrant' in the Netherlands. 

These employees from abroad generally have a certain expertise that is hard or impossible to find within their own country's borders. Therefore, there is plenty of reason to show interest in this as an employer. 

But how does this whole prcoes work next? As an employer, what all do you need to know to allow a highly skilled migrant to work in the Netherlands in a legal, responsible way? 

For a full answer to that question, let's start at the beginning.

What is a highly skilled migrant?

When we talk about a highly skilled migrant, we normally refer to a knowledge migrant from outside the EU or the EEA (incl. Switzerland). This is a highly skilled worker who is capable of performing certain work-related activities at a high level. 

Therefore, the main reason for migrating to the Netherlands is to express specific knowledge or skills with an employer for a specific fee. In this way, these knowledge migrants make an important contribution to the Dutch economy. 

Being a migrant, a residence permit is normally required. 

How does the IND procedure for a knowledge migrant work?

As an employer, to then bring a knowledge migrant to the Netherlands, it is important to follow the correct procedure for this. We soon refer to this as an IND procedure. This includes a number of steps you have to go through as an employer to meet all legal requirements when bringing in a highly skilled migrant. 

In broad terms, this involves the following roadmap (this may vary slightly for each knowledge migrant): 

  • IND to be recognised as a sponsor: First of all, as an employer, you must be recognised by the IND as a sponsor. The IND refers to the Immigration and Naturalisation Service. To be eligible for this at all, you as an employer must meet certain conditions. For example, you must be registered with the Chamber of Commerce, be financially sound and be labelled 'reliable' as an organisation in the broad sense.

  • Employment contract: Next, there must be a valid employment contract between employer and knowledge migrant. On that front, consider, for example, meeting the salary requirements for knowledge migrants. These depend on age and type of work.

  • Application for residence permit (+ possibly first provisional residence): In addition, as an employer, you must apply for a residence permit for the knowledge migrant. Please note that for some cases and situations, an application for a Regular Provisional Residence Permit (MVV) is required first. If necessary, this can be applied for at the Dutch embassy or a consulate in the country of origin. Once the MVV is approved (if it was needed at all), it is then possible to apply for a residence permit with the IND.

  • Decision application by IND: After submitting the application to the IND, they start assessing it. In doing so, it looks at whether all the conditions set are met (e.g. salary requirements). Based on this, the IND will make a decision and you will be told the result both as an employer and as a knowledge migrant.

  • Finalise onboarding knowledge migrant: When all previous steps have been successfully completed, the knowledge migrant can in principle come to the Netherlands to start working for the employer as soon as possible.

There is a lot of variation in exactly what needs to be done based on the nationality, age and specific knowledge of the migrant(s) in question.

Employer requirements for working with knowledge migrant.

If you want to work with highly skilled migrants in the Netherlands, you still have to meet certain conditions. This is because it is not simply possible to make this decision yourself and then hire one or more highly skilled migrants on your own. 

The Dutch government has specifically set out a number of requirements that provide employers with a clear framework of what you need to comply with. The main requirements are: 

  • Being an approved referent with IND: First of all, you cannot avoid the fact that, as an employer, you have to be a recognised sponsor with the IND. As you read in the first step of the IND procedure earlier, the Immigration and Naturalisation Service has to make you an authorised sponsor as an employer. To make this possible, there are several conditions you have to meet. It comes down to giving you the stamps of 'reliable' and 'financially sound'.   • Offer legal employment contract: As an employer, you must also offer the highly skilled migrant(s) a legal employment contract. This should clearly state, among other things, what the knowledge migrant's exact position will be, what salary is involved and how the other terms of employment are worked out in detail. In other words; it is crucial that everything in this area is worked out in a professional manner, so that no misunderstandings can arise in any possible way.

     

  • Meeting income requirements knowledge migrants: Finally, note that the salary must therefore at least meet the standard amount set by the IND for knowledge migrants that applies. These are adjusted every year. It is therefore smart to always check what the current standard amounts are. For instance, they are higher for knowledge migrants over 30 years old.
